We operate the website https://chikiba.com/ (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

chikiba is an online platform for browsing product listings related to Japanese pop culture and comparing prices, availability, and shop offers from various retailers worldwide. The service is intended to help users discover products, compare offers more easily, and make more informed purchasing decisions. chikiba does not sell products directly, but redirects users to third-party shops where purchases may be completed under the respective shop's own terms and conditions.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We may update these Legal Terms from time to time. We will indicate changes by updating the "Last updated" date of these Legal Terms. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services.

Some listings may contain NSFW or otherwise sensitive product imagery. Such content may be hidden, blurred, filtered, or require additional confirmation before being displayed.

1. Our Services

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use or internal business purpose.

Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

Feedback and submissions

If you send us feedback, suggestions, bug reports, listing corrections, shop information, product information, or similar materials, the rules in the Contribution License section apply. This does not transfer ownership of your existing intellectual property to us.

3. User Representations

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity and agree to comply with these Legal Terms; (4) you are not under the age of 13; (5) you are not a minor, or if a minor, you have received parental permission; (6) you will not access the Services through automated or non-human means; (7) you will not use the Services for any illegal or unauthorized purpose; and (8) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. Payments Through Third-Party Providers

chikiba does not sell the listed products directly and does not process payments for purchases made with third-party shops. Purchases from third-party shops are completed outside chikiba and are governed by the respective shop's own terms, prices, payment methods, cancellation policies, refund policies, and customer support processes.

If optional paid memberships, support tiers, sponsored placements, or similar paid features are offered, payments may be processed through third-party providers such as Patreon or other payment platforms. We do not directly collect or store your full payment card details through chikiba.

6. Subscriptions

Optional paid memberships

chikiba itself may be available without a paid membership. Optional paid memberships or support tiers may be offered through third-party platforms such as Patreon. Such memberships are not required to browse the basic chikiba website unless expressly stated otherwise.

Billing and renewal

Optional memberships may automatically renew according to the billing model and terms of the respective third-party provider.

Cancellation

Users can cancel an optional paid membership by logging into their account with the relevant third-party provider and managing or cancelling the membership there.

Refunds

Refund requests for optional paid memberships or other payments processed through a third-party provider must be submitted and handled through that provider. Refunds are not guaranteed and may be reviewed according to the provider's applicable refund policies.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without written permission from us.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Circumvent, disable, or otherwise interfere with security-related features of the Services.
• Use any information obtained from the Services in order to harass, abuse, or harm another person.
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Use the Services in a manner inconsistent with any applicable laws or regulations.
• Engage in unauthorized framing of or linking to the Services.
• Upload or transmit viruses, Trojan horses, or other harmful material that interferes with any party's uninterrupted use and enjoyment of the Services.
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using data mining or similar data gathering tools.
• Delete the copyright or other proprietary rights notice from any Content.
• Attempt to impersonate another user or person or use the username of another user.
• Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
• Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services.
• Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
• Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
• Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email.
• Use automated systems, bots, scraping tools, crawlers, or similar methods to access, copy, extract, monitor, or collect data from the Services without our prior written permission.
• Impersonate any shop, retailer, partner, company, or other third party, or falsely claim an affiliation with chikiba or DenDen Arts GmbH.
• Interfere with, manipulate, bypass, or abuse affiliate links, tracking systems, referral mechanisms, rankings, ratings, reviews, filters, price alerts, or other platform features.
• Submit, provide, or attempt to display false, misleading, outdated, manipulated, or unauthorized product, price, availability, shop, or listing information.
• Sell, rent, license, or otherwise transfer your account or profile.

8. User Generated Contributions

Certain features of chikiba may allow registered users to submit product ratings, reviews, feedback, listing corrections, or similar contributions.

We may restrict, remove, edit, hide, decline, or limit content, ratings, or reviews that are unlawful, misleading, abusive, infringing, spam-like, commercially manipulative, unreliable, or otherwise unsuitable for the Services.

9. Contribution License

If you send us feedback, suggestions, bug reports, shop information, product information, listing corrections, product ratings, reviews, or similar materials, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, adapt, display, publish, moderate, aggregate, analyze, and process such materials for the purpose of operating, improving, protecting, and promoting the Services.

You are responsible for ensuring that any materials you send to us are accurate to the best of your knowledge and that you have the necessary rights to provide them.

10. Ratings and Reviews

Product rating and review features may only be used by registered users. Unless we expressly allow otherwise, each user may submit no more than two product ratings or reviews per calendar day.

We may remove, restrict, hide, decline, or limit ratings or reviews that we consider unreliable, abusive, commercially manipulative, unlawful, automated, duplicate, or otherwise unsuitable for the Services.

11. Social Media and External Platforms

We may maintain profiles or pages for chikiba or DenDen Arts GmbH on third-party social media platforms and other external services. Your use of those external platforms is governed by their own terms, policies, and technical settings. We are not responsible for the availability, content, moderation, account actions, or data practices of third-party platforms.

12. Third-Party Websites and Content

The Services may contain links to third-party websites and may display content, information, images, offers, product data, advertisements, or other materials provided by or relating to third parties. We do not control third-party websites or content and do not guarantee their accuracy, availability, legality, completeness, or reliability.

To the extent permitted by applicable law, chikiba and DenDen Arts GmbH are not responsible for third-party websites, products or services, fulfillment, delivery, cancellations, refunds, customer support, or any decisions you make based on third-party information displayed through the Services.

13. Advertisers

We may allow advertisers, sponsors, affiliate partners, retailers, or other commercial partners to display advertisements, sponsored content, product offers, shop information, or other commercial information in certain areas of the Services. Advertisers, sponsors, retailers, and other third parties remain responsible for their own offers, content, products, services, legal compliance, and customer relationships.

14. Services Management

We may manage the Services where reasonably necessary to operate, secure, improve, and protect the platform, our users, our partners, and our rights. This may include reviewing activity for violations of these Legal Terms, restricting or disabling access to accounts, content, listings, feeds, or features, removing or declining information that is unlawful, misleading, abusive, technically harmful, or burdensome to our systems.

16. Term and Termination

If your account or access has been restricted, suspended, or terminated because of a violation, you must not try to bypass that measure by creating a new account.

These Legal Terms are governed by and interpreted in accordance with the laws of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the European Union, you also retain the protection of any mandatory consumer protection provisions of the law of your country of residence. To the extent legally permitted, disputes relating to these Legal Terms shall be submitted to the competent courts in Munich, Germany.

19. Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

21. Disclaimer

The Services are provided on an as-is and as-available basis. We do not guarantee that the Services will always be available, uninterrupted, error-free, complete, current, or suitable for a particular purpose.

Product information, prices, availability, shop information, shipping information, import-related information, images, release dates, and other listing details displayed on chikiba may be incomplete, outdated, or incorrect. We do not guarantee the accuracy, completeness, reliability, or timeliness of third-party information displayed through the Services.

Nothing in these Legal Terms limits or excludes liability where such limitation or exclusion is not permitted by applicable law.

22. Limitations of Liability

We are liable without limitation for intent, gross negligence, and injury to life, body, or health. We are also liable where mandatory law does not permit a limitation or exclusion of liability.

In cases of slight negligence, we are only liable for the breach of essential contractual obligations. In such cases, liability is limited to the typical and foreseeable damage.

To the fullest extent permitted by applicable law, we are not liable for indirect damages, consequential damages, lost profits, lost revenue, lost savings, loss of data, loss of goodwill, business interruption, or losses arising from reliance on third-party shop information, third-party offers, price errors, availability errors, shipping estimates, import-related estimates, affiliate links, sponsored links, external websites, or third-party services.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold DenDen Arts GmbH harmless from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the Services, your breach of these Legal Terms, your infringement of third-party rights, your submission of false or misleading information, or your misuse of platform features. This indemnification obligation does not apply where a claim was caused by our own intent, gross negligence, or another circumstance for which liability cannot be limited or excluded under applicable law.

chikiba is an online platform for browsing product listings related to Japanese pop culture and comparing prices, availability, and shop offers from third-party retailers. chikiba does not sell the listed products directly and is not a party to any purchase agreement between users and third-party shops.

28. Product Information, Prices, and Availability

Product information, prices, availability, images, release dates, and other listing details shown on chikiba may be incomplete, outdated, or incorrect. Only the final information shown by the respective third-party shop at the time of purchase is binding.

Product images and related visual materials displayed on chikiba may include third-party content used for product identification, comparison, and informational purposes. chikiba does not claim ownership of third-party product images, character names, trademarks, brand names, logos, or related intellectual property. All such rights remain with their respective owners.

29. Shipping, Customs, Taxes, and Import Fees

Users are responsible for any applicable shipping costs, taxes, customs duties, import fees, handling fees, and other additional charges related to purchases from third-party shops, unless such costs are expressly included or collected by the respective shop. Any information displayed on chikiba regarding such costs is provided for convenience only and may not reflect the final amount charged.

When users click on links to third-party shops, they leave chikiba and access external websites under the respective third party's own terms, policies, and responsibility. chikiba and DenDen Arts GmbH are not responsible for third-party websites, products, services, fulfillment, delivery, cancellations, refunds, or customer support.

31. Affiliate Links and Sponsored Links

Some links on chikiba may be affiliate links or sponsored links. chikiba may receive compensation when users click on such links or make purchases through them. This does not make chikiba the seller of the products and does not affect the purchase relationship between the user and the respective third-party shop.
